Rules and Regulations

  • These rules and regulations  are in place to provide everyone with a great place to live. We expect everyone living here to gladly support them.
     
     
    I. General
    A. Applications must be completed and approved, security deposit, first month's rent, and last month's rent must paid prior to the arrival of the resident's mobile home. The management reserves the right to refuse admittance and refund any advance deposits and payments to anyone whose mobile home is not acceptable in appearance and condition.
    B. All rents are payable in advance by the first of each month. Anyone who does not have rents paid on time, unless otherwise arranged for in writing, may be directed to leave the park within thirty (30) days at the option of management. Rents shall be mailed or delivered to the resident office by the 10th of each month
    C. A late charge of $30.00 will be charged on each charge unpaid after 10 day grace period.
    D. No subletting, renting, or occupation by anyone not listed on the application will be permitted except with written approval of the management.
    E. Every tenant is expected to maintain the appearance of his/her manufactured home, lot, and keep them in there best possible appearance.
    F. Tenants must retain ownership and store their home’s tires and axles.
    G. Mobile Homes are single family dwellings.
    H. An approved skirting will be provided by the resident and placed around the mobile home within 30 days of arrival. The management reserves the right to have skirting installed after this time, and to bill the resident the actual cost.

     II. Conduct
    A. No peddling, soliciting, “for sale” signs or commercial enterprise is permitted in the park except with written approval of the management.
    B. Disorderly conduct, abusive language, noisy disturbances, or disregard of the rules and regulations contained herein shall be grounds for immediate removal of all persons committing said offenses from the premises.
    C. Parents will be held responsible for any damage caused by their children. Tenants will be responsible for their guests and pets.
    D. Park curfew for children under the age of 18 is 10:00 p.m. weekdays and 11:30 p.m. on Friday & Saturday. It is the tenant’s responsibility to know where their children and guests are.
    E. Village Green reserves the right to evict/terminate/banish anyone interfering with park security.
    F. Drunkenness or immoral conduct will not be tolerated. No alcoholic beverages are to be consumed around the pool area, streets, playground or any other common area in the park.
    H. The management will not be responsible for accidents, injuries, or loss of property by fire, theft, wind, floods, or other natural acts which are beyond its control. Equipment and apparatus furnished on the grounds are solely for the convenience of residents and all persons using same do so at their own risk.
    I. The management shall be notified immediately of any hazardous conditions which are known to be a violation of these rules and regulations, or otherwise.
    J. Every resident shall be responsible for any violation of these rules and regulations by a member of his/her family, or his/her guest.
    K. Any violation of these rules and regulations by a resident that is uncorrected by him/her or that causes damage to a dwelling or seriously interferes with the comfort or safety of another resident, shall be grounds for termination of the lease.
    L. Fireworks are prohibited on the park property and the areas around the park.
    M.Firearms, slingshots, air rifles or any other devices that could caus
    e harm to life/and or property are expressly forbidden outside your own home. Violators will be immediately prosecuted.
    N. The management reserves the right to alter these rules and regulations as circumstances require, upon seven (7) days prior written notice to residents.
    O. Garage, moving, yard sales allowed not to exceed 3 days in time.

     III. Vacating of Premises
    A. All residents shall notify the management as far in advance as possible when planning to vacate. Residents must check out according to the following conditions in order to have their security deposit returned:
     1) The management must be notified in writing received by management at least thirty (30) days before the resident(s) intend to vacate.
     2) Village Green will refund the tenant’s security deposit within 30 days:

       if and when:
                     a). All the lot rent is paid & current.

                     b). No damage has been done to park property.

                     c). Management approves the condition of home in order for it
                           remain in the park

                     d). There are no outstanding inspection violations.                                                                        

                     e). Potential buyers/renters are approved at the Village Green
                            Office  prior to the purchase or rental of the home.

                     f. The resident must provide management with their new
                         
    address in writing.

     

    3). It is the owner’s responsibility to make sure that the new resident signs a lease and pays his/her security deposit. The home will not be taken out of the tenant’s name until all of the above items are done, nor will you security deposit be refunded.

    4). Mobile homes may not be sold with the understanding that the buyer may retain the same lot without prior consent of the management.


    IV. Mobile Home Lots
    A. Lots may be inspected periodically by the management.
    B. No changes, alterations, or additions to mobile home lots may me made by the resident without written approval of the management. Skirting, porches, awnings, and other additions, if approved by the management, shall be maintained in good repair by residents.
    The titled owner of the home must contract a person who is a licensed contractor with the City of Mishawaka, and who is bonded and insured in order to demolish a mobile home on site. A copy of the contractor's license, insurance, demolition permit, and a $5,000 demolition bond must be delivered to the resident office 7 days before the work begins. The demolition of a home may not exceed 7 days time. If it exceeds 7 days, Village Green will remove the remaining debris at the mobile home owners expense.
    C.
    The resident shall be responsible for proper placement of his mobile home on his foundation stand and proper installation of all utility connections in accordance with the instruction of the management.
    D. The management will supply utility connections to each lot; each resident shall be solely responsible for the proper connection of the utility connection from his mobile home. No occupant shall tamper with or alter the utility connection owned by the park.
    E. The management reserves the right of access onto all lots at all times for the purpose of inspection and utility maintenance.
    F. Connection to the park-owned utility should be made with all applicable regulations.
    G. If a lot is neglected, the management reserves the right to take over its care and bill the resident the actual cost of maintenance. No violation of any ordinance, statute, regulation, rule or state law pertaining to the use of the leased property will be tolerated.
    H. The resident is responsible to keep the grass on his lot mowed and in presentable appearance. Except for trees, bushes, flowers, and gardens, all grass and ground cover shall not be permitted to exceed three (3) inches in height.


  • I. Tenants shall keep and maintain their premises in a clean and sanitary condition at all times.

       1). Accumulation of garbage will not be tolerated. Garbage pick up is on 
            Mondays. Excessive garbage will be removed at owner’s expense.

       2). Grass must be mowed and properly disposed of. The pond, a ditch, or any common area is not allowed.  

       3). Should any tenant choose to not to mow their grass it will be mowed
            for them, without notice, and charged $50.00.

       4). Leaves and yard waste are to be bagged and put at the curb for
            garbage pick up. Do not rake them into ditches, lake, or any other
            common area.Large trimmings from trees or bushes should be tied or
            bagged in small bundles for trash removal. Village Green will not
            remove them for you.      
    J. The resident is responsible to keep the parking area of his lot, sidewalks, etc., cleared of snow and ice.
    K. Management will keep park roads passable year-round. No tenant has the right to alter or obstruct the construction, repair, or clearing of the road. All roads are private roads for the use of residents and their invitees, and management only.
    L. Boats, boat trailers, or other such equipment shall only be stored on individual lots if and when it is registered, has current plates and approved by park management. Storage will only be permitted with pre-approval from management.
    M. An approved skirting will be provided by the resident and placed around the mobile home within thirty (30) days after arrival. The management reserves the right to have skirting installed after this time, and to bill the resident for the actual cost.
    N. All mobile homes shall be tied down to prevent wind damage.
    O. The blocking which contacts the ground shall be solid concrete, solid block, or block with centers poured.
    P. All resident water pipes and connections shall be frost proofed by the resident. Any damage caused to the park water lines or mobile home water system, because of frost or water lines freezing of resident water pipes and connections shall be repaired at the tenant's expense. The management reserves the right to have park property repaired in such instances and bill the tenant.
    Q. The tenant's house number shall be clearly visible on the home.
    R. Mail boxes shall be placed only at the space provided and shall be of a type approved by the management. The tenant's name and address shall be clearly visible on the mail box.
     
    V. Automobiles, Trucks, and Other Vehicles
    A. Vehicles shall be parked only in the designated area. Vehicles shall not be parked in or along park roads, or in undesignated areas on the lots.
    B. No unlicensed or inoperable vehicles will be permitted in the park. Vehicles not removed by owner in a timely manner will be removed by the management at the owner's expense.
    C. The speed limit in the park is fifteen (15) miles per hour and drivers will be alert for children or pedestrians.
    D. No Parking allowed on the grass. No exceptions. During the months of November thru April there will be no on street parking. This is for snow removal. Anyone parking in the street at this time will be subject to their vehicle being towed at their own expense.
    E. No semi-tractors or Trailers allowed in the park at anytime. Parking of semi tractors and trailers will only be allowed behind the front office. If you leave your car parked in this lot be sure to get a parking pass from the office. This is a tow away zone.
    F. No repairs are to be made to any motor vehicle at the mobile home site. No cars on jacks etc.
    G. The parking of no more than two conventional properly registered vehicles will be allowed for each mobile home lot, unless widening of the driveway has been permitted and completed.
    H. No off road vehicles allowed in the park (example; dirt bikes, go carts, 3 wheelers, snowmobiles, etc.) If the vehicle can not be licensed it cannot be driven in the park. This includes the property surrounding the park as well.

     I. Campers & mobile homes are not to be stored on your lot, the street or an empty lot. They must have current registration and plates. Campers and motor homes are allowed in your driveway for the purpose lof loading and unloading them. This shall not exceed 24 hours.

    VI. Buildings and Facilities

    A. Storage buildings and surrounding area will be the tenant's responsibility. The management reserves the right to enter storage buildings for inspection at any and all reasonable times.
    B. Arrangements for the use of the community’s property must be made with the Village Green office prior to use.
    C. Homes and/or adjacent structures damaged by fire, accident, wind, etc must be replace, repaired or removed within 30 days.
    D. Sheds must be constructed of wood only; shingled roof, T-111 or vinyl sided. No Metal sheds allowed.
    E. Fence may be chain link or wood with a maximum height of 4 feet. Grandfathered taller fences may be repaired but no replaced. Those with taller fencing must move to our current guidelines when the fence reaches a state of disrepair. You must fill out a fence permit with our office before installation.
    F. Each resident is cautioned against driving of rods, stakes, pipes, etc into the ground, or digging in an area before checking with the office. Many types of underground installations might be endangered by indisriminate action. Any damage of this type will be charged to the resident by the utility involved. The best way to avoid extra costs and possible injury is to call before you dig 1-800-382-5544


    VII. Exterior of Home

    A. Window air conditioners are allowed if properly supported and secured.
    B. Only umbrella type or temporary clotheslines are allowed and must be taken down when not in use.
    C. No TV, ham or CB antennas allowed. Small dish satellites may be used if installed attached to your home or behind a fence out of the public view.
    D. Portable basketball hoops are allowed but must be kept in good condition and stored appropriately for winter months.
    E. Appropriate window coverings required, curtains and or blinds. No blankets or sheets as curtains.
    F.
    Trampolines allowed if and only if tenant provides the Village Green office with proof of liability equal to or greater than $500,0000, and the trampoline is enclosed with a fence with a lock. Anyone possessing a trampoline without completing the above is subject to having the trampoline removed from their property.


    VIII. Solid Waste Disposal, Storage, and Fire Protection
    A. Residents shall provide their own garbage cans.
    B. All garbage must be in plastic bags and placed in garbage containers. Garbage containers used for mobile home site shall be tightly covered and fastened to prevent their blowing freely in park. Plastic garbage bags may not be left exposed out of doors.
    C. The garbage containers shall be rodent proof, insect proof, and water tight.
    D. The space under the mobile home shall not be used for storage of any nature.
    E. VERY IMPORTANT: The septic system may only be used for human waste, toilet paper, and typical wash water. Women's feminine products, food and other trash must be disposed of in the garbage.  If we find these items the tenant will be charged.
    F. No garage, moving, yard, or other sales will be allowed except on specified dates listed in the spring newsletter.

     VIV. Pets

    A. Permission must be obtained from the office if you wish to obtain a pet.
    B.No animals, except for household pets, shall be brought into the park.
    C.All dogs must be licensed with the City of Mishawaka.
    D.The City of Mishawaka general provision -CHAPTER 91:  ANIMALS is available at the Village Green office upon request.
    E.
    All dogs in Village Green (temporary or permanent) must be contained within a privacy fence, unless being walked by a person able to control the dog on a leash.
    F.Dogs may not be left outdoors continuously, even in a privacy fence.
    G.If a dog is barking, it must be taken in immediately. If the resident is not home, the dog cannot be left out. Noisy or unruly pets or those that cause complaints will not be allowed to remain.
    H.Outdoor-only pets are prohibited.
    I.No dog houses allowed in the park.
    J.No dogs can be chained out, NO EXCEPTIONS!.
    K.
    If a dog is found running loose, it will be turned over to the Humane Society.
    L.Anyone who disobeys these rules twice within six months will lose their privileges to keep pets on Village Green property.

    M. Dogs must meet the requirements listed below.
       1).. Np pitbull/pitbull mixes
       2). All dogs must be registered at the office along with the dog’s license and any other information that is warranted.
       3). Any dog that is not registered will be removed immediately.
    N.
    If your dog bites another dog or person, your pet must be removed from the community immediately. No exceptions.

    XX Community Areas

    A. The swimming pool is available to all residents of Village Green. Guests may use the pool if accompanied by a resident and purchase a guest pass at the office. All residents must obtain a pass from the office and bring to the pool to use this facility.
    B. The lake is available for fishing and boating only. Man and wind powered crafts are acceptable as well as electric motors. No gas vehicles allowed. All persons in boat must wear lifejackets or have access to state approved flotation devices.
    C. Public lake access is near the Community office only. Please do not use the private lots for lake access. The area approximately 15 feet from the water's edge is for public use.. No bicycles or other transportation vehicles allowed around the lake. Please clean up after yourself so everyone can enjoy the lake's beauty.
    D. Basketball courts are for Village Green residents only. Courts close at dusk.
    E. The playgrounds are meant for enjoyment of our children. Parents are encouraged to accompany their children to the park.

    Suggestions to Tenants:
    Have fire extinguishers at central locations in your mobile home where they are readily accessible.
    Have smoke detectors installed in your mobile home. Each person's safety is the concern of all persons in the community.
    In order for the management to provide you with a community in which you will be comfortable, you need to inform the management of infractions of regulations, and make suggestions as to how we can make our community better.
